overturns 1 in 12 verdicts in teacher misconduct cases"},"content":{"rendered":"<p class=\"s6\"><span class=\"s2\">The education secretary has quietly overruled the proposed punishment in almost one in 12 recent teacher misconduct cases, prompting warnings<\/span><span class=\"s2\"> that <\/span><span class=\"s2\">public trust in the process <\/span><span class=\"s2\">could be<\/span><span class=\"s2\"> undermined.<\/span><span class=\"s2\">\u00a0<\/span><\/p>\n<p class=\"s7\"><span class=\"s5\">Officials have changed the verdicts for 18 <\/span><span class=\"s2\">teachers over the <\/span><span class=\"s2\">p<\/span><span class=\"s2\">ast 12 months following <a href=\"https:\/\/www.gov.uk\/government\/organisations\/teaching-regulation-agency\" target=\"_blank\" rel=\"noopener\">Teaching Regulation Agency <\/a><\/span><span class=\"s2\">(TRA) <\/span><span class=\"s2\">hearings, data obtained by Schools Week shows.<\/span><span class=\"s2\">\u00a0<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">The figure <\/span><span class=\"s2\">\u2013 <\/span><span class=\"s2\">7 per cent of cases <\/span><span class=\"s2\">\u2013 <\/span><span class=\"s2\">is a record high and double the number <\/span><span class=\"s2\">of <\/span><span class=\"s2\">the previous year.<\/span><span class=\"s2\">\u00a0<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">Andrew Faux, of Lawyers for Teachers, warned that <\/span><span class=\"s2\">\u201c<\/span><span class=\"s2\">overruling panels so often will inevitably undermine public trust in the process<\/span><span class=\"s2\">\u201d<\/span><span class=\"s2\">.<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">It may also <\/span><span class=\"s2\">\u201c<\/span><span class=\"s2\">lead some accused teachers to disengage on the basis that no matter how they present to the independent panel, the sanction will be decided by a civil servant whom they never meet.<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">\u201c<\/span><span class=\"s2\">We hope that stakeholders, such as trade unions, are concerned by this development.<\/span><span class=\"s2\">\u201d<\/span><\/p>\n<h2 class=\"s9\"><span class=\"s8\">More overturned<\/span><\/h2>\n<figure id=\"attachment_246411\" aria-describedby=\"caption-attachment-246411\" style=\"width: 300px\" class=\"wp-caption alignleft\"><img fetchpriority=\"high\" decoding=\"async\" class=\"wp-image-246411 \" src=\"https:\/\/schoolsweek.co.uk\/wp-content\/uploads\/2026\/05\/Bridget-Phillipson-inaet-300px6.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><figcaption id=\"caption-attachment-246411\" href=\"https:\/\/schoolsweek.co.uk\/teaching-regulation-agency-should-reform-or-go-says-union-boss\/\" target=\"_blank\" rel=\"noopener\">TRA<\/a> consider teacher misconduct cases.<\/span><span class=\"s2\">\u00a0<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">If they conclude <\/span><span class=\"s2\">there is <\/span><span class=\"s2\">serious misconduct, they make a recommendation on whether the accused should be banned from teaching and <\/span><span class=\"s2\">the length of <\/span><span class=\"s2\">a review period before they can apply to rejoin.<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">But the final decision rests with a senior TRA official working on the secretary of state<\/span><span class=\"s2\">\u2019<\/span><span class=\"s2\">s behalf.<\/span><span class=\"s2\">\u00a0<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">Figures obtained through the freedom of information act show the education secretary<\/span><span class=\"s2\">\u2019<\/span><span class=\"s2\">s representative overruled the panel 18 times in 2025-26, the most since 2021-22.<\/span><span class=\"s2\">\u00a0<\/span><\/p>\n<p class=\"s7\"><span class=\"s5\">Seven o<\/span><span class=\"s2\">f the 18<\/span><span class=\"s2\"> had<\/span><span class=\"s2\"> a prohibition order imposed when the panel did not recommend one.<\/span><span class=\"s2\">\u00a0<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">Three others <\/span><span class=\"s2\">faced<\/span><span class=\"s2\"> a longer review period, while four <\/span><span class=\"s2\">teachers were<\/span><span class=\"s2\"> permanently banned.<\/span><\/p>\n<h2><\/h2>\n<h2 class=\"s9\"><span class=\"s8\">\u2018<\/span><span class=\"s8\">Nothing<\/span><span class=\"s8\">\u2019<\/span><span class=\"s8\">s changed<\/span><span class=\"s8\">\u2019<\/span><\/h2>\n<p class=\"s7\"><span class=\"s2\"><em>Schools Week<\/em> analysis also suggests 13 of the overturned recommendations in 2025-26 came after the new year.<\/span><span class=\"s2\">\u00a0<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">This came after Bridget Phillipson<\/span><span class=\"s2\">, the education secretary,<\/span><span class=\"s2\"><a href=\"https:\/\/www.jewishnews.co.uk\/exclusive-education-secretary-orders-urgent-review-into-unacceptable-decision-to-allow-pro-hamas-teacher-to-carry-on-working\/\" target=\"_blank\" rel=\"noopener\"> announced the launch<\/a> of an <\/span><span class=\"s2\">\u201c<\/span><span class=\"s2\">urgent review of the TRA<\/span><span class=\"s2\">\u2019<\/span><span class=\"s2\">s processes and, in particular, the framework of delegations, thresholds and mitigations related to a decision to prohibit a teacher<\/span><span class=\"s2\">\u201d<\/span><span class=\"s2\">.<\/span><span class=\"s2\">\u00a0<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">But the DfE this week insisted there <\/span><span class=\"s2\">\u201c<\/span><span class=\"s2\">has been no change in its established processes or approach in its decision<\/span><span class=\"s2\">&#8211;<\/span><span class=\"s2\">making<\/span><span class=\"s2\">\u201d<\/span><span class=\"s2\">.<\/span><span class=\"s2\">\u00a0\u00a0<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">Cases where the official verdict differ<\/span><span class=\"s2\">ed<\/span><span class=\"s2\"> from the panel<\/span><span class=\"s2\">\u2019<\/span><span class=\"s2\">s recommendation <\/span><span class=\"s2\">\u201c<\/span><span class=\"s2\">remain a small percentage of overall hearing outcomes<\/span><span class=\"s2\">\u201d<\/span><span class=\"s2\">, the department added.<\/span><span class=\"s2\">\u00a0<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">Pepe Di<\/span><span class=\"s2\">\u2019<\/span><span class=\"s2\">Iasio<\/span><span class=\"s2\">, the general secretary of the<\/span><span class=\"s2\"> Association of School and College Leaders<\/span><span class=\"s2\">, said<\/span><span class=\"s2\"> the matter should be <\/span><span class=\"s2\">\u201c<\/span><span class=\"s2\">closely monitored in line with principles of due process and a fair trial<\/span><span class=\"s2\">\u201d<\/span><span class=\"s2\">.<\/span><span class=\"s2\">\u00a0<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">\u201c<\/span><span class=\"s2\">A TRA panel, made up of education experts who are present throughout a hearing, are best placed to make a fair and informed judgment based on the evidence presented to them.<\/span><span class=\"s2\">\u00a0<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">\u201c<\/span><span class=\"s2\">If decisions are later overturned by someone not as familiar with the details of the case, and who has not been present throughout the hearing, this could lead to an increase in High Court challenges and ultimately extend the time taken to conclude the case.<\/span><span class=\"s2\">\u201d<\/span><\/p>\n<h2 class=\"s9\"><span class=\"s8\">What were the cases?<\/span><\/h2>\n<p class=\"s7\"><span class=\"s2\">Our analysis of the 18 overturned cases suggests nine centred on allegations of inappropriate behaviour or conduct with pupils.<\/span><span class=\"s2\">\u00a0<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">Three others were for criminal convictions, two for alcohol misuse and two more were based on safeguarding failings.<\/span><span class=\"s2\">\u00a0\u00a0<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">In February, Darlington teacher Samuel Everett was banned from teaching, with two year review period, after posting on social media remarks <\/span><span class=\"s2\">\u201c<\/span><span class=\"s2\">related to immigration and gender<\/span><span class=\"s2\">\u201d<\/span><span class=\"s2\">. This was despite the panel recommending against the issuing of a prohibition order.<\/span><span class=\"s2\">\u00a0<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">In one post, Everett said: <\/span><span class=\"s2\">\u201c<\/span><span class=\"s2\">There<\/span><span class=\"s2\">\u2019<\/span><span class=\"s2\">s not an Islamist problem in our country according to some. How many times do we get called racists for being English?<\/span><span class=\"s2\">\u00a0<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">\u201c<\/span><span class=\"s2\">These people come from the most intolerable and barbaric places you can imagine and think they have more rights than us. Bore off.<\/span><span class=\"s2\">\u201d<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">He<\/span><span class=\"s2\"> was judged to have demonstrated <\/span><span class=\"s2\">\u201c<\/span><span class=\"s2\">a lack of tolerance and a lack of respect for the rights and beliefs of others<\/span><span class=\"s2\">\u201d<\/span><span class=\"s2\">.<\/span><span class=\"s2\">\u00a0<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">Through FOI, the DfE also revealed education secretaries have <\/span><span class=\"s2\">\u201c<\/span><span class=\"s2\">always imposed a prohibition order in cases where the professional conduct panel has recommended one<\/span><span class=\"s2\">\u201d<\/span><span class=\"s2\">.<\/span><span class=\"s2\">\u00a0<\/span><\/p>\n<figure id=\"attachment_246410\" aria-describedby=\"caption-attachment-246410\" style=\"width: 300px\" class=\"wp-caption alignright\"><img decoding=\"async\" id=\"caption-attachment-246410\" class=\"wp-caption-text\">Andrew Faux<\/figcaption><\/figure>\n<p class=\"s7\"><span class=\"s2\">But since 2018, there have been 13 occasions where a shorter review period was imposed than the one recommended.<\/span><span class=\"s2\">\u00a0<\/span><\/p>\n<p class=\"s7\"><span class=\"s2\">Faux added: <\/span><span class=\"s2\">\u201c<\/span><span class=\"s2\">We have always reassured teachers that TRA panels are fair<\/span><span class=\"s2\">&#8211;<\/span><span class=\"s2\">minded and independent and that the secretary of state usually follows their recommendation.<\/span><span class=\"s2\">\u00a0\u00a0<\/span><\/p>\n<p class=\"s10\"><span class=\"s2\">\u201c<\/span><span class=\"s2\">We have noted a sharp departure from the usual practice this year, and it is good to see that our &#8216;gut feel&#8217; is proved correct by the diligent research by <em>Schools Week.<\/em><\/span><span
